These general terms and conditions (GTC) apply to all contracts between Emmi Ultrasonic GmbH and consumers (Section 13 BGB) that are made via our online shop. A consumer is any natural person who concludes a legal transaction for a purpose that can neither be attributed to their commercial nor their independent professional activity.

4. Conclusion of a contract

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. By clicking the button "Send order" you are placing a binding order for the goods in the shopping cart. The confirmation of the receipt of your order takes place together with the acceptance of the order immediately after sending it by automated e-mail. 6. Payment Methods

7. Collection by the customer

We deliver by dispatch, and it is also possible to collect the goods directly from our warehouse.

8. Offsetting

You are only entitled to offset if your counterclaims have been legally established by a court or are undisputed or have been recognized by us in writing.

9. Right of retention

You can only exercise a right of retention if the claims result from the same contractual relationship.

10. Retention of title

The goods remain our property until full payment. If your address changes during this time, please inform us immediately.

11. Cancellation policy

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

In order to exercise your right of withdrawal, you must inform us (Phone: +1 561-463-6120 or Info@EmmiDent-Ultrasound.com) by means of a clear declaration (e.g. by post sent letter, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. The right of withdrawal does not apply to the following contracts:

• Contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the consumer's personal needs.
• Contracts for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.
• Contracts for the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature.

Guarantee

The warranty is subject to legal regulations. In the case of all defects occurring during the statutory warranty period of two years from delivery, you have the statutory right to supplementary performance (at your option: removal of the defect or new delivery) and - if the legal requirements are met - the statutory right to a reduction in price or withdrawal as well as to compensation. You have to give us a total of two attempts at improvement. If the type of supplementary performance you require is only possible at disproportionate costs, your claim is limited to the other type of supplementary performance.
